Good Morning Speakasians,

I wish all my Speakasian a very joyous Chaitra Navratri Festival 2012.
I have just now realized that on the day of our AGM i.e. 31st March, 2012 is Sri Durga Maha Ashtami and Annapurna Ashtami. With the divine blessings of Durga Maa, we will forge ahead with courage and strength in our fight for our livelihood and safeguarding our monies.
It has truly been a hectic week starting from 15th March, 2012 and I try and take you through the activities as below:
March 15th: A joyous day for all Speakasians, a milestone moment which we will remember for a long time to come. On this eventful day Mr. Navnit Khosla the original complainant had withdrawn his complaint and made a statement before the Hon’ble Bombay High Court that as his claims were paid off in full he was not interested in pursuing his complaint which was being investigated under CR 60/2011 by the EOW Mumbai. I wish to remind the entire family that this complaint was the beginning of the EOW investigation in the Speakasian matter and with this withdrawal; I sincerely hope that the investigation will come to an end.
March 17th: The EOW preferred to serve on me the 72 hours notice of arrest in spite of me having written to them on the same day, the EOW received my letter at 12.15 pm and within a couple of hours of this receipt at 2.00 pm they served me with the notice. In my letter addressed to the IO Mr. B.P.Shelke I have stated and reminded him how on every occasion that I have been summoned, I have always appeared before him and have always given him the required information and statements have been recorded to that effect. I was shocked to have received this notice and I realized that the authorities were now being vindictive against me only because I was the voice of the Speakasia Panelist family.
The fight and the movement of AISPA which represents a large family has become huge, it is no longer about one individual, it is the fight of the aspirations of over 12.5 lakh Panelists, this is a fight for our constitutional right to earn a honest livelihood, this is our fight to ensure that our money is safeguarded and is returned to us. Nobody can deny us this fight; no agency can stop us from fighting for our rights.
March 19th: We moved the Sessions court for filing my Anticipatory Bail for protection against the impugned 72 hour notice. The Hon’ble Sessions court posted the matter for hearing on the next day i.e. on the 20th March, 2012.
On the same day we filed our “AFFIDAVIT IN REJOINDER” in reply to the affidavits filed by the Respondents in the WP 3611/2011 in the Hon’ble Bombay High Court.
Later in the evening we held a Press Conference at the Mumbai Press club and addressed the media and brought out before them the other side of the Speakasian matter through the eyes of the Panelists. The video of the Press conference are already uploaded on aispa.co.in
March 20th: it was a tense morning as the ABA was going to be heard and decided, the hearing which was scheduled No. 1 on the board was eventually heard at around 1.20pm. The EOW asked for some time to file their reply in my Anticipatory Bail Application and the matter was adjourned to 3rd April, 2012 but not before the Court recording that the Learned Special PP under instructions of the IO has given an undertaking that they do not intent to arrest me till the next date. The rest of the day was spent in meetings with our counsel discussing and preparing for the next day when we were going to mention our WP 3611/2011 for an urgent hearing.
March 21st: We reached the Hon’ble Bombay High Court a little anxious but with great hope in our heart. Melwyn ji and I did not know that today we will witness history being written, with the judgment of the Bombay High Court staying all investigation in the Speakasia matter under CR 60/2011, this has come as a huge relief for all Speakasians, indeed a historical day for the entire Speakasian family.
March 22nd: AISPA’s new WRIT PETITION filed in the original side of the Mumbai High Court was slated for hearing on the question of the constitutional right of all individuals to organize themselves under an Association and the freedom to form, run and manage the activities of the Association without any interference from the state.
This is a very important and huge movement where an Association of ordinary law abiding citizens is approaching the Hon’ble High Court for seeking protection against the might of the State in our constitutional right to run an Association.
Our Counsel drew the attention of the Hon’ble Divisional Bench of the Hon’ble High Court to the case of Mr. Ratan Tata having filed a WRIT in the Hon’ble Supreme Court for the right to privacy of an individual in the Radia Tapes Matter, similarly this was a Writ being filed by a group of common citizens seeking protection of their constitutional rights to run an Association.
March 23rd: We have come to realize that the matter slated for hearing on 23rd March, 212 in the Hon’ble Supreme Court in the SLP 7509 & 7510/2011 for quashing of AP FIR’s have been adjourned to 27th April, 2012.
We the panelists should not be too much concerned or bothered about this as this is the company initiative and I am sure that they are more concerned about the matters than we are. We have to understand that this matter has no bearing on our first objective that of Website return and start of payments under the EXIT OPTION.
When this matter assumes significance I am confident that the company will take steps to get the matter heard at the earliest.
March 24th: There are many rumors doing the rounds that the Mumbai High Court matter has been preponed from 4th April to 27th March, 2012. As I write this update no such confirmation is with us and I think this is just a rumour and we should not spend much time discussing this. The Bombay High Court Order of 21st March is abundantly clear that the learned PP has been asked to get the required clarification from the Hon’ble Supreme Court where the matter is slated for the 2nd April, 2012. The respondents cannot approach the same bench for any appeal.
In light of the above clarification I do not think this information is correct and this rumor is not warranted.
Regarding the AGM to be held on the 31st March, 2012: AISPA wishes to bring to your kind notice that the inflow of forms is quite high and we are finding it difficult to process the same but we will leave no stone unturned to see that all forms are processed. Our sincere request is that all the people who wish to attend this AGM and take part in the election process should see that at least their individual Membership forms should reach us latest by 29th March, 2012.
AISPA will not be responsible for delay in receiving forms and should not be held responsible if your name does not appear on the Membership List.
LAST DATE FOR REGISTRATION FOR AGM WILL BE 29TH MARCH 2012. REGISTRATION WILL THEN RESTART FROM 2ND APRIL, 2012.

Business Restart: The latest company communication with us through the BlogSpot talks of early Business restart. I also feel the same and do not see any hindrance in the restart of business; business restart is not too far away.
I shudder to imagine what will happen when the business restarts especially after such a prolonged investigation in the matter how the world will react, how the Speakasians will cope up with the load of the upcoming business opportunity.
To begin with, if the company is able to implement even 50% of what they announced as their plans in Goa during the GenX, Speakasia is poised to make huge HISTORY. All Speakasians who have stood by the company will be the direct beneficiaries of this HISTORY.

Today I have a song in my heart that business restart is not a very far away goal. It is visible in the near future and if we can all carry this song, this short last journey will become easy to endure.
